1. Scope and seller

(1) These Terms and Conditions apply to all contracts concluded via the online shop at 2kapselnbitte.de between you and us,

Corp Capsula GmbH
Kolonnenstraße 8
10827 Berlin
Germany
represented by its managing director Lennart Hero Lühring
Commercial register: Amtsgericht Charlottenburg, HRB 277426 B
E-mail: office@corp-capsula.com

“2 Kapseln Bitte” is a brand of Corp Capsula GmbH.

(2) Our offer is directed at consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 German Civil Code, BGB). A business is a natural or legal person or a partnership with legal capacity acting in the exercise of its trade, business or profession when concluding the contract (Section 14 BGB). Provisions that apply only to consumers or only to businesses are marked as such.

(3) Orders may only be placed by persons aged 18 or over.

(4) We do not accept deviating terms of businesses unless we expressly agree to them in text form.

2. Conclusion of the contract

(1) The presentation of products in the online shop is not a legally binding offer but an invitation to place an order.

(2) You can add products to the shopping cart and change quantities or remove products there. In the checkout you enter your contact and delivery details and choose the shipping and payment method. Before submitting the order, all details, the products and the total price including taxes and shipping costs are displayed again; you can correct input errors there using the respective edit functions or the usual keyboard and mouse functions, or cancel the ordering process by closing the browser window.

(3) By clicking the “Place order with obligation to pay” button (German: „Zahlungspflichtig bestellen“), you submit a binding offer to purchase the products in the shopping cart. You then complete the payment process with the chosen payment service.

(4) The contract is concluded as soon as the payment process has been successfully completed, i.e. the payment service has authorised or confirmed the payment. We confirm the conclusion of the contract to you by e-mail without undue delay; this e-mail contains the content of the contract and refers to these Terms and the withdrawal information (confirmation on a durable medium, Section 312f (2) BGB). If the payment cannot be completed, no contract is concluded.

(5) Should an ordered product exceptionally not be available, we will inform you without undue delay and refund any payments already made via the original means of payment without undue delay. Your statutory rights remain unaffected.

3. Contract language and storage of the contract text

(1) The contract language is German. Translations of these Terms are for information only; the German version prevails.

(2) We store the contract text. You receive the order details with the confirmation e-mail; these Terms and the withdrawal information are linked there and can be accessed and printed on this website at any time. If you have a customer account, you can view your orders there.

4. Prices, shipping costs and duties

(1) The prices stated in the online shop are final prices. For deliveries within the European Union they include the statutory VAT. Deliveries to Switzerland, Liechtenstein and Norway are VAT-exempt export deliveries; there the price includes no VAT (paragraph 3). The price at the time of the order applies.

(2) Shipping costs are charged in addition. Their amount depends on the country of delivery and is shown in the shopping cart and in the checkout before you submit the order, as is any order value from which delivery is free of charge.

(3) For deliveries to countries outside the European Union (Switzerland, Liechtenstein, Norway), import VAT, customs duties where applicable and carrier fees for customs clearance may be charged in the country of destination. These are not included in our prices and are payable by the recipient to the customs authority or the carrier. We point this out in the checkout.

5. Delivery

(1) We deliver to the countries offered in the checkout. Goods are shipped with DHL from our warehouse in Berlin.

(2) The delivery time is shown for the respective shipping method in the checkout. It begins on the day after the contract is concluded (section 2 (4)). If the end of the delivery time falls on a Saturday, Sunday or public holiday at the place of delivery, it ends on the next working day.

(3) We only make partial deliveries where this is reasonable for you; you will not incur additional shipping costs as a result.

(4) For consumers, the risk of accidental loss and accidental deterioration of the goods only passes upon handover to you. For businesses, the risk passes upon handover to the carrier.

6. Payment

(1) The payment methods shown in the checkout are available to you, depending on the country of delivery in particular credit and debit card, Apple Pay, Google Pay, PayPal, Klarna, Amazon Pay and Wero. Payments are processed by our payment service provider Stripe Payments Europe, Ltd., Dublin, Ireland.

(2) The purchase price is due upon conclusion of the contract. For purchase on invoice or instalments via Klarna, Klarna’s terms, which are displayed to you before completion, apply additionally; the payment term and payee result from those terms.

(3) If you save a card for future purchases when paying, it is stored with Stripe; you can remove it in your customer account at any time.

(4) Businesses may only set off claims that have been finally established by a court, are undisputed or have been acknowledged by us, and may only exercise a right of retention on the basis of claims arising from the same contractual relationship.

7. Cancellation before shipping

As long as your order has not yet been shipped, you may cancel it voluntarily and without giving reasons in your customer account or by sending us a message; we will refund the amount paid via the original means of payment. Your statutory right of withdrawal remains unaffected.

8. Retention of title

The goods remain our property until paid in full.

9. Right of withdrawal

(1) Consumers have a statutory right of withdrawal. Details are set out in our withdrawal information, which also contains the model withdrawal form. You can also withdraw from the contract at any time within the withdrawal period via our online withdrawal function.

(2) The right of withdrawal expires prematurely for sealed goods which are not suitable for return due to health protection or hygiene reasons if they were unsealed after delivery (Section 312g (2) no. 3 BGB). This applies in particular to our sealed porcelain jars, containers and refill pouches.

10. Warranty and transport damage

(1) The statutory warranty rights apply. For consumers, claims based on defects in new goods become time-barred two years after delivery of the goods.

(2) For businesses the following applies instead: the limitation period for claims based on defects is one year from delivery, except for fraudulently concealed defects, claims for damages under section 11, the scope of any guarantee given and in the event of recourse under Sections 445a, 478 BGB. Businesses must inspect the goods without undue delay after receipt and notify defects without undue delay (Section 377 German Commercial Code, HGB).

(3) If goods are delivered with obvious transport damage, please complain to the carrier immediately if possible and inform us. If you do not do so, this has no consequences for your statutory rights as a consumer; however, you help us to assert our own claims against the carrier.

(4) The best-before date stated on the packaging is not a defect as long as the goods still have a reasonable shelf life on delivery. We deliver goods with a remaining shelf life that allows the pack to be used as intended within the best-before date.

(5) In addition to your statutory rights, we grant consumers a 60-day satisfaction guarantee: within 60 days of delivery we refund the purchase price of one opened pack per product, without the need to return it; shipping costs are not refunded. Details are set out in our guarantee terms. Your statutory rights, in particular the right of withdrawal and your warranty rights, are not restricted by it.

11. Liability

(1) We are liable without limitation for damage resulting from injury to life, body or health, for damage based on intent or gross negligence, under the German Product Liability Act and to the extent of any guarantee given.

(2) In the event of a slightly negligent breach of an essential contractual obligation, the fulfilment of which makes the proper performance of the contract possible in the first place and on the observance of which you may regularly rely (cardinal obligation), our liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.

(3) These liability provisions also apply in favour of our legal representatives and vicarious agents.

12. Information on food supplements

(1) Our products are food supplements. They are not a substitute for a varied and balanced diet and a healthy lifestyle. The stated recommended daily intake must not be exceeded. Keep out of the reach of young children.

(2) The mandatory information under the Food Information Regulation (EU) No 1169/2011, in particular ingredients, allergens, nutrient content, recommended intake and warnings, is available before purchase on the respective product page and on the packaging; the best-before date is printed on the packaging. If you are pregnant or breastfeeding, have a medical condition or take medication, please consult your doctor or pharmacist before use.

(3) Our customer service provides general product information but no individual medical advice.

13. Customer account

(1) You can create a customer account, including by signing in with Google, Apple, Facebook, Microsoft or Amazon where offered. There is no entitlement to an account.

(2) Keep your login details secret and inform us if you suspect misuse.

(3) You can have your customer account deleted at any time; a message to us is sufficient. Statutory retention obligations for order and invoice data remain unaffected (see privacy policy).

14. Customer service and codes of conduct

(1) You can reach our customer service by e-mail at office@corp-capsula.com, via the contact form and live chat on our website and via the messengers stated there. We usually answer enquiries within one to two working days.

(2) We have not subscribed to any specific codes of conduct.

15. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 German Consumer Dispute Resolution Act, VSBG). If you have questions or complaints, you can reach us at office@corp-capsula.com; we will endeavour to find an amicable solution.

16. Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Berlin.

(3) Should individual provisions of these Terms be invalid, the remainder of the contract remains valid; the invalid provision is replaced by the statutory provisions.
